This Policy explains how to notify us of alleged intellectual property infringement, how we act on such notices, and how a party affected by a takedown may respond. It reflects our position as an intermediary under Section 79 of the Information Technology Act, 2000 and the Intermediary Guidelines Rules, 2021. For complainants outside India we also accept notices in the form contemplated by the US Digital Millennium Copyright Act (DMCA).
1. Our Content
All logos, graphics, text, photographs, listing descriptions, visual renders, software code, and database compilations on this Platform are the exclusive property of KRP Tech Solutions OPC Private Limited or its content suppliers, protected under Indian and international copyright and trademark law.
You may not reproduce, duplicate, copy, resell, or exploit any portion of the Platform for commercial purposes without express written consent. Data mining, robots, AI-training scrapers, and automated extraction tools are prohibited.
2. Submitting a Takedown Notice
Send notices to support@nearby-petstore.in, marked "Copyright Takedown Notice", addressed to the Nodal Grievance Officer. A valid notice must include:
- Identification of the copyrighted work or trademark claimed to be infringed;
- The exact URL(s) on this Platform where the material appears;
- Evidence of your ownership or authority to act for the owner (registration number, prior publication, or equivalent proof);
- Your full name, postal address, telephone number and email address;
- A statement that you believe in good faith that the use is not authorised by the owner, its agent, or law;
- A statement that the information in the notice is accurate, and that you are the owner or authorised to act on the owner's behalf;
- Your physical or electronic signature.
Incomplete notices cannot be actioned. Knowingly making a material misrepresentation may expose you to liability.
3. How We Act on a Notice
| Acknowledgement | Within 24 hours of receipt. |
| Assessment and disposal | Within 15 days of receipt. |
| Court or government order | Content removed or disabled within 36 hours, as required by Rule 3(1)(d). |
| Repeat infringers | Accounts of repeat infringers are suspended or terminated. |
4. Counter-Notice
If your material was removed and you believe this was in error or that you hold the necessary rights, you may send a counter-notice to the same address containing: identification of the removed material and its former location; a statement, under penalty of applicable law, that you believe the removal resulted from mistake or misidentification; your contact details; and your signature. We may restore the material unless the original complainant initiates legal proceedings.
5. Safe Harbour
Nearby Pets India operates as an intermediary in respect of third-party content, including listing content supplied by verified breeders and partner farms. We do not initiate transmission, select the receiver, or modify such content, and we observe due diligence as required to retain the protection of Section 79 of the IT Act, 2000. Acting on a takedown notice is not an admission of liability.
