This page is for police officers, investigating agencies, and courts. It sets out the legal instruments we act on, what data we hold, how to serve a requisition on Nearby Pets India, and the timelines within which we respond. It supplements our Privacy Notice and Grievance Redressal Policy.

2. Legal Basis We Act On

We disclose customer data only where we are legally required to do so. We accept:

  • A written requisition under Section 94 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 (formerly Section 91 CrPC), signed and stamped, citing the FIR / Crime / DD number;
  • An order of a competent court;
  • A statutory summons or legally binding directive from an authority acting within its jurisdiction;
  • A written notice under the Information Technology Act, 2000 or the Intermediary Guidelines Rules, 2021.

We do not disclose customer data over the telephone, over informal messaging, or to a requester who cannot produce a written instrument. This is not obstruction — it protects the evidentiary value of the disclosure and our obligations under the Digital Personal Data Protection framework.

3. What a Valid Requisition Must Contain

  1. Officer's full name, rank/designation, and service or ID number;
  2. Police station, district and State;
  3. Official email address and an official contact number;
  4. FIR / Crime / DD number and the sections invoked;
  5. The specific identifiers you are asking about — order number, registered mobile number, email address, or transaction reference. Requests for bulk or unspecified customer data cannot be actioned;
  6. The precise data sought and the period it relates to;
  7. A scanned copy of the signed and stamped notice on official letterhead.

4. What We Hold

Order recordsCustomer name, delivery address, contact details, items ordered, amounts, and order status history.
Payment metadataGateway transaction references and settlement status. We do not store card numbers, CVV, or net-banking credentials — these remain with the PCI-DSS compliant gateway.
Technical logsSubmission IP address, timestamp, and browser metadata captured at form submission and order placement.
CommunicationsSupport correspondence and order notifications sent to the customer.
RetentionFive years from the last transaction, in line with tax and audit obligations. Data outside this window may no longer exist.

5. Preservation Requests

If you need records preserved while a formal requisition is being obtained, send a preservation request to legal@nearby-petstore.in identifying the order or account. Preservation is not disclosure — we will place a hold and simply not delete the specified records for 90 days, extendable on written request. No data is released until a valid legal instrument is received.

6. Emergency Disclosure

Where there is a credible risk of imminent danger to the life or physical safety of a person, we will act on an emergency request without waiting for a formal requisition. Such requests must be made to legal@nearby-petstore.in or +91 92430 08606, must describe the nature of the emergency, and are approved by the Nodal Officer. Every emergency disclosure is logged in full, and the requesting authority is asked to follow up with the formal instrument.

7. Our Response Timelines

AcknowledgementWithin 24–48 hours of receipt.
Preservation hold appliedWithin 24 hours of a valid preservation request.
Substantive responseWithin 15 days of a valid requisition, or sooner where the notice specifies a shorter statutory period.
Court/government removal ordersContent removed or disabled within 36 hours, per Rule 3(1)(d) of the Intermediary Guidelines.
Emergency requestsSame day.

8. How We Respond

Disclosure is made by written reply from the Nodal Officer to the official email address on the requisition, enclosing only the data specifically sought, together with a certificate identifying the FIR number, the records produced, and the date of production. We maintain an internal audit record of every request received, every disclosure made, and the officer who authorised it.

We do not charge for responding to lawful requisitions.

9. Why There Is No Officer Login

We are sometimes asked for a direct login to view order data. We do not provide one, for reasons that protect both sides:

  • A government email domain identifies an organisation, not an individual officer, their rank, or their jurisdiction over a particular case. Domains such as @gov.in and @nic.in are held by employees across every department of government, not only the police.
  • Granting database visibility on the strength of an email domain would breach the purpose-limitation and data-minimisation requirements of the DPDP framework, exposing customers unconnected to any investigation.
  • A single compromised or spoofed mailbox would become a route to the entire customer database.
  • A screenshot from a self-service panel is weaker evidence than a signed disclosure certificate from a named nodal officer, which is what stands up in court.

The requisition channel above gives you a faster, better-evidenced answer than a portal would.

10. Notice to Customers

Our policy is to notify a customer when their data has been sought, unless we are barred from doing so by the terms of the order, by law, or where notification would prejudice an ongoing investigation or risk harm to a person.
